私埋猝死1歲幼子　情侶涉殺人不起訴

【黃哲民／新北報導】32歲邱姓女子與33歲黃姓同居男友被指涉9年前殺害1歲兒子，草率葬在新北市汐止區第七公墓廢棄墓穴，涉犯殺人等罪嫌。新北地檢署今年5月掘出男童骨骸，發現並無遭毆打凌虐跡象，研判男童是病死，今將邱女與黃男均不起訴。

邱女與黃男供稱，當年每晚都要擺攤賣燒烤到凌晨，不得已將3歲長子與1歲幼子放在家裡，回家發現幼子已無氣息，黃男當時另案被通緝，才私下找葬儀社處理下葬。

檢方認為父母不得將6歲以下兒童獨處，何況3歲幼童連自己都無法照顧，如何照顧1歲弟弟，邱女與黃男涉犯最重可判2年的過失致死罪嫌，但此刑責在《刑法》修正前僅有5年追訴期，警方2009年底獲報調查時，早已超過追訴期，只能將2人不起訴。
