控鄰怠速排廢氣妨害「呼吸權」　男敗訴

【丁牧群／台北報導】家住新北市三芝區的陳姓男子，今年5月在一樓家中聞到臭味，一開門發現羅姓鄰居的小貨車停在門口，引擎發動著但車上沒人，汽車廢氣不斷飄進陳家，陳男怒告羅姓鄰居夫妻妨害自由，主張羅夫妻剝奪他「呼吸新鮮空氣權利」，但士林地檢署今將羅夫妻不起訴。
 
檢方偵辦時，傳喚社區警衛作證，警衛說當時接到陳男通知前往處理，但抵達時羅男的貨車並沒發動。檢察官認為，就算停在陳男家門前的貨車是發動的，廢氣也會先散逸在巷道間，無法證明羅夫妻使用強暴脅迫手段強逼陳男呼吸廢氣，因此不構成妨害自由罪。
